1. Acceptance of These Terms
These Terms of Use ("Terms") govern your access to and use of Spectrum Navigator, including its website, accounts, provider directory, search tools, messaging, appointment requests, reviews, notifications, and related services (collectively, the "Service").
By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. What Spectrum Navigator Is
Spectrum Navigator is a technology, directory, discovery, communication, and provider-management platform designed to connect families with autism, developmental, behavioral, educational, caregiving, and related resources.
Spectrum Navigator is not itself a healthcare provider, therapy provider, insurer, emergency service, or clinical decision-maker.
3. No Medical Advice
Information available through Spectrum Navigator is for informational and directory purposes. Nothing on the Service constitutes medical advice, diagnosis, treatment, psychological advice, legal advice, or a recommendation that a particular provider or treatment is appropriate for any individual.
Users should consult qualified professionals regarding medical, developmental, behavioral, educational, or therapeutic decisions.
Spectrum Navigator is not an emergency service. If you believe someone is in immediate danger or experiencing an emergency, contact the appropriate emergency services in your location.
4. Eligibility and Accounts
Accounts are intended for adults who are legally capable of entering into these Terms. Family accounts should be created by parents, guardians, caregivers, or other authorized adults.
You agree to provide accurate information, maintain the security of your account, protect your password, and promptly update information that becomes inaccurate.
You are responsible for activity conducted through your account unless prohibited by applicable law.
5. Provider Listings
Provider information may be submitted by providers, organization owners, their authorized representatives, or obtained through other lawful means.
Providers are responsible for maintaining accurate listing information, including services, locations, insurance participation, availability, credentials, contact details, and other representations.
A provider's appearance on Spectrum Navigator, including a "Verified" or approved status, does not constitute a guarantee or warranty by Spectrum Navigator regarding quality, licensing, credentials, suitability, safety, availability, insurance participation, outcomes, or regulatory standing.
Families remain responsible for independently evaluating providers and verifying information important to their decisions.
6. Appointment Requests
Spectrum Navigator may allow families to send appointment or contact requests to providers.
Sending an appointment request does not create a confirmed appointment or provider-client relationship. An appointment is not confirmed unless the provider communicates acceptance or confirmation.
Providers are solely responsible for scheduling, clinical intake, eligibility, availability, cancellations, and services ultimately provided.
7. Messaging
Spectrum Navigator may provide messaging between families and providers.
Messaging should be used responsibly and should not be relied upon for emergencies. Users should avoid transmitting unnecessary medical records, highly sensitive personal information, payment credentials, or other information that is not reasonably necessary for the communication.
8. Reviews
Users who are eligible to submit reviews must provide truthful, good-faith descriptions of their own experiences.
Reviews may not contain threats, harassment, unlawful content, spam, impersonation, intentionally false statements, private information, or content unrelated to the reviewed provider.
Spectrum Navigator may investigate, restrict, remove, or retain content in accordance with our policies and applicable law.
9. Acceptable Use
You may not misuse Spectrum Navigator, interfere with its operation, attempt unauthorized access, scrape or harvest information in violation of law or these Terms, distribute malware, impersonate others, create fraudulent accounts, manipulate reviews, harass users, circumvent security controls, or use the Service for unlawful purposes.
10. User Content
You retain ownership of content you lawfully submit, subject to the rights necessary for Spectrum Navigator to operate the Service.
By submitting content intended for public display, such as provider information, photographs, logos, descriptions, or reviews, you grant Spectrum Navigator a non-exclusive license to host, store, reproduce, display, format, and distribute that content as reasonably necessary to provide and promote the Service.
You represent that you have the right to submit the content you provide.
11. Third-Party Services
Spectrum Navigator may link to independent provider websites or integrate services operated by third parties.
Spectrum Navigator is not responsible for the content, availability, services, privacy practices, or conduct of independent third parties.
12. Suspension and Termination
Spectrum Navigator may restrict, suspend, or terminate accounts or listings when reasonably necessary to address violations of these Terms, suspected fraud, security risks, unlawful conduct, provider misrepresentation, abuse, nonpayment, or risks to users or the Service.
Users may stop using the Service at any time. Provider subscription obligations are additionally governed by the Provider Terms.
13. Service Availability
We work to keep Spectrum Navigator available and reliable, but we do not guarantee uninterrupted or error-free operation.
Features may be modified, improved, suspended, or discontinued as the Service evolves.
14. Disclaimer of Warranties
To the fullest extent permitted by law, Spectrum Navigator is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory.
We do not warrant that provider information will always be complete or current, that any provider will meet a user's needs, or that any particular outcome will result from use of the Service.
15. Limitation of Liability
To the fullest extent permitted by law, Spectrum Navigator and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to use of the Service, provider conduct, provider services, third-party websites, loss of data, or inability to access the Service.
Nothing in these Terms excludes liability that cannot lawfully be excluded.
16. Indemnification
To the extent permitted by law, you agree to be responsible for claims, losses, or expenses arising from your unlawful use of the Service, your violation of these Terms, or content you submit in violation of another person's rights.
17. Governing Law
These Terms are governed by the laws of the State of Arizona and applicable federal law, without regard to conflict of law principles.
To the extent a dispute may lawfully be required to proceed in a particular location, courts located in Arizona will have jurisdiction.
18. Changes to These Terms
We may update these Terms as Spectrum Navigator evolves. Continued use after an updated version becomes effective constitutes acceptance to the extent permitted by law.
